Iraqi Kurdistan, officially known as Kurdistan Region is an autonomous administrative entity within the Republic of Iraq. The region was founded in 19 May 1992, and officially recognized in 15 October 2005. This page provides an overview of copyright rules of Kurdistan Region relevant to uploading works into Wikimedia Commons.
Background
editThe Kurdistan region of Iraq was founded in 19 May 1992, and officially recognized in 15 October 2005.
Since 2013, the Kurdistan Region had its own copyright law[1][2] that's different from the rest of Iraq, according to Article 44, which says:
Suspending the implementation of the Iraqi Copyright Law No. 3 of 1971 and its amendments in the Kurdistan Region.[17/2012 Art. 44]

General rules
editUnder Kurdistan's Copyright Law No.17 of 2012,
- The author’s economic rights provided are protected throughout the lifetime of the author and for 50 years from the date of his death.[17/2012 Art. 23 (1)]
- The economic rights relating to works of joint authorship are protected throughout the lives of all co-authors and for 50 years from the death of the last survivor.[17/2012 Art. 23 (2)]
- For collective works other than works of applied arts,
- Where the copyright holder is a legal entity, the economic rights are protected for 50 years from the date on which the work was published or made available to the public for the first time, whichever comes first.[17/2012 Art. 23 (3)]
- Where the copyright holder is a natural person, the protection period shall be calculated for their life plus 50 years.[17/2012 Art. 23 (3)]
- The economic rights relating to a work published for the first time after the death of the author expire after 50 years from the date on which the work was published or made available to the public for the first time, whichever comes first.[17/2012 Art. 23 (4)]
- The economic rights relating to a work published anonymously or under pseudonym shall be protected for a period of 50 years, from the date on which the work was published or made available to the public for the first time, whichever comes first.[17/2012 Art. 23 (5)]
- The economic rights of the author of a work of applied art expire after a period of 25 years from the date on which the work was published or made available to the public for the first time, whichever comes first.[17/2012 Art. 23 (6)]
- The provisions of the 2012 Law apply to works starting from the first day of the next year, provided the term of protection for those works had not yet fallen into the public domain.[17/2012 Art. 23 (7)]

Under the 2012 law the following are not protected:[17/2012 Art. 5]
- Abstract ideas, procedures, working methods, operating techniques, concepts, principles, discoveries and scientific data, theories, mathematical equations, statistical graphs, whether expressed, described, illustrated, or included in a work.
- Daily news published, broadcasted, or publicly announced.
- Collections of official documents such as texts of laws, regulations, international agreements, judicial rulings, and other official documents.
- Insignias and symbols such as flags, circulating medals, and official military uniforms.
- Collections of works that have fallen into the public domain.

- The duration of protection for performers' rights shall be 50 years from the date of performance, after the date of first fixation of the sound performance or its publication or making it available to the public, whichever is earlier.[17/2012 Art. 32 (1)]
- The duration of protection for producers of sound recordings shall be 50 years from the date of fixation, after the date of publication of the recording. In case of non-publication, the period shall be calculated from the date of first fixation of the recording.[17/2012 Art. 32 (2)]

Not OK: Under Kurdistan's Copyright Law No. 17 of 2012,
- The protection shall include the following: ... Works of drawing, painting, sculpture, engraving, applied arts, and decorative arts.[17/2012 Art. 3(8)]
- The economic rights of the author are transferable, either partially or completely. The author alone or their heirs enjoy the financial benefits of their work, regardless of the direct means of exercising this right. They have the right to grant permission or prohibition in these regards: ... Copying, printing, recording, and photographing the work by all available means.[17/2012 Art. 8(2)]
