- Actually, after asking the uploader where the cake and photo were made (Canada), I might have to retract that. Canadian law[1] states that it is not an infringement of copyright (under subheading "Non-infringement re certain designs") to make a useful article (the cake) and then reproduce the article (take a picture of the cake) except "a representation of a real or fictitious being, event or place that is applied to an article as a feature of shape, configuration, pattern or ornament".
