其是匿名或笔名作品（作者身份从未被公开），又或是集体创作作品^[2]，且自其出版以来已过去超过70年（CPI art. L123-3）；
其属于已经进入公有领域的视听或音乐作品的录音，且自演奏或录制以来已过去超过50年（CPI art. L211-4）。

请注意即便作品进入公有领域，其著作人身权仍可适用。这包括但不限于对作者姓名、质量及工作尊重的权利（CPI art. L121-1）。有鉴于此，必须提供作者的署名。
