其是匿名或筆名作品（作者身份從未被公開），又或是集體創作作品^[2]，且自其出版以來已過去超過70年（CPI art. L123-3）；
其屬於已經進入公有領域的視聽或音樂作品的錄音，且自演奏或錄制以來已過去超過50年（CPI art. L211-4）。

請注意即便作品進入公有領域，其著作者人格權仍可適用。這包括但不限於對作者姓名、質量及工作尊重的權利（CPI art. L121-1）。有鑒於此，必須提供作者的署名。

↑ 著作權延伸規則只有針對音樂作品，或對於法蘭西烈士（Mort pour la France，即在衝突中為法國服役而死）才必須考慮。其他情形下，其著作權期限長度一律認定為作者一生及死後70年（參見法國最高法院的聲明）。
